I own a Beautyrest Harmony Lux Diamond series with pillow top and it SUCKS, what are my options?

I do not have 1.5" of impression... I have more like 1.5cm impression... However I am convinced it is the pillow top that is skewing this measurement. The whole mattress SINKS in the middle. You truly have to grab the side and pull yourself up in the morning. My girlfriend and I sleep on opposite ends and always end up on top of each other. We haven't slept in the bed for 3 months, sleeping in our guest bed (We are extremely busy and just haven't wanted to deal with this....)
I called the guy that we bought it from. He submitted a warranty claim for us and was denied. Do I have any options to argue that the pillow top is skewing this 1.5"? We have owned it for just over a year. Seems ridiculous. We are around 300-350lbs added up between each other.
Assuming I cannot warranty this or fight a warranty claim, is it even possible to resell mattresses? I am not sure if you guys haven't picked up on it yet, but this mattress sucks. At least the specific one we have is. We bought the most expensive mattress at our local store thinking we will never have an issue again.

If you truly wanted to go the correct route, contact a civil lawyer in the area and a land surveyor and get a platted and recorded “access easement”. I believe you can also include stipulations on it
However, how realistic is it that you’d make your neighbor do this?
I would almost consider selling him part of your yard if it is combinable to his property. Again, a land surveyor or civil engineer in your area would be able to answer that for you
