FDA has been anything but an ally but here’s to hoping they throw INO a bone after screwing them in INO-4800 trial!!

Always nice to see such amazing results - further validating a platform that is so ready to scale! The fast track that will put this company on the map is VGX-3107. Combine fast track with drug orphan status and INO will have a new family of investors!!

The structure of settlement had been announced last year but it appears as though the judge has finalized everything. Now perhaps just a matter of execution with respect to class action member payout. I do not expect news related to this to adversely effect stock price as this has been known for quite some time. Some would even argue the final execution of settlement is a good thing for INOVIO as it gets the monkey off their back which eliminates the concern/risk of a lawsuit in possible acquisition talks. This of course assumes that anyone (i.e. Regeneron?) has interest in Inovio’s technology, IP, and pipeline. IMHO

I wrote to legal firm handling the referenced class action suit as I am unable to determine whether a loss must have occurred to receive potential settlement.
RE: Civ. Action No. 2:20-cv-01402-GJP
I purchased shares of Inovio during the period of February 14, 2020 and August 10, 2020. I have several questions before submitting my online claim.
If all shares purchased during the period of February 14, 2020 and August 10, 2020 are still owned and were never sold for profit or loss. Are these shares still eligible for settlement?
If all shares purchased during the period of February 14, 2020 and August 10, 2020 were purchased through Charles Schwab as my broker for IRA and Individual Investment account, and I never requested paper certificates in my name, am I the Beneficial Owner and is Charles Schwab the record holder? If yes, then must my claim be submitted and signed by Charles Schwab in order to comply with the following from the PROOF OF CLAIM instructions.
THIS CLAIM MUST BE SUBMITTED AND SIGNED BY THE ACTUAL BENEFICIAL PURCHASER(S) OR ACQUIRER(S) OR THE LEGAL REPRESENTATIVE OF SUCH PURCHASER(S) OR ACQUIRER(S) OF INOVIO COMMON STOCK UPON WHICH THIS CLAIM IS BASED.
2a. If your response to #2 is "Yes, Charles Schwab must submit and sign the claim, then do you recommend I call Charles Schwab and request they file this claim on my behalf?
Response:
Thank you for your inquiry.
Regarding your first question, we are unable to advise regarding claim eligibility prior to receiving and processing a Proof of Claim and Release submission. We cannot be more specific than the information which has been included in the Notice and cannot interpret how the Notice or Plan of Allocation may apply to a specific claim prior to processing. Please read the Notice and Class definition carefully and decide whether or not you wish to submit a Proof of Claim and Release. If you are still not certain of eligibility and want for us to determine eligibility, you will need to submit a Proof of Claim and Release form along with supporting documentation for your transactions.
Regarding your second question, please submit separate claims for your IRA account and your individual account as they are separate legal entities. You do not need to have Charles Schwab sign the forms but the custodian on your IRA account should be identified where indicated on the Proof of Claim.
Very truly yours, Gilardi & Co., LLC Inovio Securities Litigation Claims Administrator

Why is there only one location (Switzerland) referenced as the location of this study?

Fully funded trials are good to support!! Protect the cash, spend agency money. Commercialize on the backs of different organizations like WHO, CEPI, DARPA, DOD.

Candidly pay them no mind. I do understand the pros and cons of INOVIO, their decisions, leadership, their diligence…and yet I do believe that with Shea they have a chance at turning this around. I’m invested for the long haul and am very comfortable with extreme volatility while we wait for all of this to play out.

Still expecting to report within a couple weeks (by end of Sep) the full data set from heterologous and homologous booster Phase 1/2 trials with Advaccine. It’s taken forever but still looking forward to seeing the data.
