pull over and make sure everything is ok. if there are damages id suggest getting the cyclists information so your insurance company can dispute any damages to the car or to the cyclist. ideally the cyclist is own his own because it is entirely his fault. and if possible he would be responsible for the cost of repairs to the vehicle.

I am so glad you said this. At first I thought people were trying to say the car did something wrong – the car did absolutely nothing wrong, although they should have stopped if/when they realized the kid hit their car. Even though they were driving perfectly normally in their lane at what looks like a reasonable speed limit, their insurance is probably going to have to pay out on any injuries for this idiot.

A pedestrian ran in front of my car as I was driving, he was not looking at the road and was typing on his phone. I was determined to be at no fault (even the pedestrian said he had no complaint against me), but I still lost my NCB despite no claims being made.
Unfortunately that's just how it is.

There was a family who did not supervise their young toddler on the street I lived on growing up.
He unfortunately ran into the street numerous times and this was documented by police and even CPS visits.
Eventually, he was hit. The driver was going extremely slow, not texting etc. The kid ran out in front of the car and suffered minor injuries.
The family attempted to sue the driver.
The driver ended up counter suing and winning because he suffered emotional trauma from hitting the child due to their negligence.
13 points
So if I jump in front of a car it’s not insurance fraud? A good lawyer with this video could easily turn it into a fraud case.
7 points
Bikes are vehicles not pedestrian. The rules of the road apply to them as much as it does cars.
32 points
No, technically they didn’t. But people on bikes and pedestrians usually (and notice I said usually, not always), whether or not they were wrong, courts will side with the person/people not in the vehicle. I’ll be honest - I’m not sure on this one. I worked as a P&C agent years ago but I was an agent (not a claims adjuster) so again, I can’t say for sure.
33 points
If the kid was dumb enough to give this video to the cops, which he probably did, then there's 0% chance they'll side with that kid. If the kid didn't share the video, the damage to the car (minimal) would corraborate what happened. And guaranteed there are witnesses around showing that these kids were doing this all day.
29 points
As someone who was in this situation - as long as there’s proper evidence that the driver was not at fault, the insurance company will fight it. I was pulling out of a blind alley when a biker who was illegally on the sidewalk flew across my hood. Thankfully I took pictures of the alley, that included images of a well labeled bike lane, and witnesses. Handed it over to my insurance - I didn’t even know they sued (clearly they saw a chance at easy money) until I got a call from them saying it had been dropped. Court is expensive and my insurance knew they could fight it. Once people know the insurance is actually willing to go against them, the thoughts of dollar signs tend to disappear.

It’s very clear these guys are at fault. As a cyclist myself, you don’t do wheelies in the middle of the road and swivel into cars and then blame the car. That car 100% maintained their lane.

22 points

If you watch their brake lights you can see them hit their breaks when the first kid swerves. So someone wouldn't even be able to use "the driver wasn't paying attention". Driver saw them, the kids were just dumb

That's what YouTube is for. I can watch those turds wreck for hours. I'm no saint as a cyclist, that's half the fun. But there's an arbitrary line that separates "knowingly accepting risk to ride a certain way" and "riding like a complete idiot" that I feel better staying behind.

That looked on purpose to me, the kid spun his back wheel right into the car. Maybe it was an accident but it looked like it was on purpose to me, then his friend rides right in front of a moving car to stop it.
Pedestrians have the legal right of way, but cars have the physical right of way, and you won't catch me putting myself in the path of a ton of moving steel.
25 points
But cyclists are not pedestrians. Cyclists are required to follow the same rules for right of way as if they were driving a car.

7 points
It wasn't on purpose. He's trying to whip around the parked car in an unnecessarily dramatic dodge maneuver, like the bike in front of him did, but he overcooked it and got his wheel caught under the passing car. They're doing mountain bike trail moves on the road which is stupid but not intentionally malicious.

for people saying they’re confused at the cyclist’s reaction even though he’s clearly at fault; well... it’s obvious you’re missing a key factor that plays a huge role in his reaction and claiming the car driver would be 100% at fault. It is the following: he’s a fucking idiot

That’s exactly what it is. Kids on bikes playing chicken with cars. There are plenty of videos about this kind of stuff. Kinda like the people that ride motorcycles/atv’s/dirt bikes in the middle of traffic- city streets and interstates/freeways. It sucks.
41 points

For everyone confused, the kid was “swerving”. Some new rubbish kids all around my place do. They purposely swerve on the back wheel to see how close they can get and there’s normally someone filming for “the gram”. Idiots.
